Charge Over Equitable Interest

A Charge over Equitable Interest is a mortgage given by one party over a property that is jointly owned.

Creditors can sometimes insist that IVAs are secured using a Charge over the Equitable Interest of the debtor, which means that if the IVA fails for any reason, then creditors can look to your home for repayment of your debts.
